Terms of Service

Please read these Terms of Service ("Terms") carefully before using Fontezzi (the "Service"), operated by Lightning Wave LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Fontezzi, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Fontezzi is a browser-based design tool that converts font glyphs into scalable vector graphics (SVG) paths for use in creative and development projects. We offer both free and paid subscription tiers.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly at support@fontezzi.com if you suspect unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Infringe the intellectual property rights of others, including font licenses
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Use the Service to transmit harmful, offensive, or malicious content
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use automated scripts or bots to access the Service in a manner that degrades performance

5. Intellectual Property

Your Content. You retain full ownership of and all intellectual property rights in any designs, projects, snapshots, and output files you create using the Service. Fontezzi claims no ownership over your creative work.

License to Operate the Service. By using the Service, you grant Lightning Wave LLC a limited, non-exclusive, royalty-free license to store, process, and display your content solely as necessary to provide the Service to you. This license ends when you delete your content or close your account, subject to our data retention policy.

Anonymized Data for Improvement. We may derive anonymized, aggregated statistical representations from usage patterns and content interactions (such as structural characteristics of designs, tool usage sequences, and feature engagement) to improve the Service and to train or evaluate machine learning and artificial intelligence models. Such derived data does not include your personal information and cannot be used to reconstruct or re-identify your individual designs. See our Privacy Policy for further details.

Our Content. All software, trademarks, logos, and content provided by Fontezzi remain our exclusive property and are protected by applicable intellectual property laws.

Font Licensing. The Service integrates with Google Fonts and may support other font sources. You are solely responsible for ensuring that your use of any font complies with its applicable license.

6. Subscription and Billing

Paid plans are billed in advance on a recurring basis (monthly or annually as selected). You authorize us to charge your payment method at the start of each billing period. You may cancel your subscription at any time; access continues until the end of the paid period. Refunds are not provided for partial billing periods except where required by law.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIGHTNING WAVE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Lightning Wave LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including Sections 7, 8, 9, and 11.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
